Ideally, the Superior Court of California can rule that the marital status of a couple is terminated no earlier than six months after the Petition for dissolution of marriage has been filed with the Court. The same six month minimum requirement exists for a legal separation and for the termination of a registered domestic partnership.

However, given the fiscal difficulties that the State of California is experiencing, it typically takes longer than six months for the Court to handle any Petition for dissolution of marriage action.

In addition, the Court’s calendar takes precedence over any other calendar. And, hearing and trial continuances routinely occur during a divorce action. As such, rarely does a divorce action proceed as fast as anyone expects it to proceed.
